These Terms and Conditions regulate access to our website www.anicymanuguian.com and its use by anyone. You may use our software on this site at no cost to visit, compare and purchase, if you wish, the products and services we offer. We recommend that you read these Terms and Conditions carefully so that you understand them and have no doubts about browsing or buying from us.
These Terms and Conditions will apply and be deemed to form a part of all purchases and services contracted with Anicy Manuguian SpA through the sales systems included in this website. Those contracts, website use and the application of these Terms and Conditions are subject to the laws of the Republic of Chile, especially consumer protection laws, and imply no waiver of the rights and actions afforded by such laws. Consequently, you will enjoy all the rights recognized by Chilean law and those granted in these Terms and Conditions.
You can read our policies on shipment, forwarding and associated costs and on exchanges and refunds on this site. The purpose is to facilitate access and increase the benefits of use, which may vary from time to time but will in no case affect consumer rights.
Anicy Manuguian SpA will strictly apply all benefits and warranties stipulated by the Consumer Protection Law in transactions performed through its site. It also adheres to all parts of the Code of Good Practices for Electronic Commerce of the Santiago Chamber of Commerce. This Code of Good Practices is available on the website of the Santiago Chamber of Commerce.
ACCEPTANCE AND UNDERSTANDING OF THE TERMS AND CONDITIONS:
These Terms and Conditions are binding and obligatory. They apply to all purchases and activities performed on the Site. Use of the Site bears implicit an understanding and acceptance of these Terms and Conditions. You must refrain from using the Site and/or the services offered on it if you do not agree with the Terms and Conditions. “User” of the Site means both registered users and guests.
CHANGES TO THE TERMS AND CONDITIONS:
The Terms and Conditions may be replaced or amended at any time, at the exclusive discretion of Anicy Manuguian SpA, which will not require User consent. The conditions prevailing at the time of any transaction will continue in force unless the amendments are more convenient for Users.
Users are responsible for reading these Terms and Conditions each time they log on to the Site to see if there have been any changes.
FREEDOM TO BROWSE AND BUY PRODUCTS AND SERVICES:
No obligation is assumed by visiting the Site unless otherwise unequivocally stated or unless you have taken action to buy certain goods or services as stated in these Terms and Conditions.
Users are categorically forbidden to do the following:
Send files or any type of information the content of which is illegal, obscene, abusive, defamatory, slanderous, or contrary to good custom;
Send files containing viruses or any other feature harmful to a computer’s operation, whether on the Site or in the system;
Use the Site to violate any type of governing law;
Register using fake information and then make a purchase; or provide false information at any other time when any other type of personal information is requested;
Offer products or services;
Use programs, software or automatic or manual devices to monitor or copy the information or any type of content from the Site without prior consent of Anicy Manuguian SpA.
All promotional or advertising communication we send electronically will bear our identity as sender and the subject matter of the communication. The informational Newsletter may be suspended by the addressee at their discretion, which will stop the forwarding of all messages to that individual.

Anicy Manuguian SpA sells only to adults over the age of 18 by any means of electronic payment available on the Site. People under age 18 may only use this Site through their parents or legal representative.
Anicy Manuguian SpA will adopt all measures necessary and prudent to protect the security of your information. You will receive an e-mail advising you of any changes in the information you recorded on the Site or of any irregularities in the transactions performed using your identification or in the means of payment, or simply as a measure of identity protection to avoid potential fraud.
If we are unable to contact you within 72 hours, for your own safety, your purchase order through the Site will not be confirmed. AUTHORIZATION FOR PERSONAL INFORMATION PROCESSING:
Our commitment is to offer products that best suit your needs. You hereby therefore expressly authorize Anicy Manuguian SpA to process your personal information provided upon making a purchase either in-store or online for the purposes indicated below, pursuant to Article 4 of Privacy Protection Law 19,628 of Chile.
Personal information means, for example, your full name, address, phone number, e-mail address, data on geolocation, use and visits to the Site, browsing history, and buying habits.
You also authorize us to contact you digitally, i.e., by phone, e-mail, SMS, WhatsApp or other similar platforms at the mobile phone number you provide in order to provide information for the purposes indicated below.
Your personal information may be treated by the Site exclusively to (i) prepare, implement, promote and offer new products and services or new attributes, modes or features of the products and services available to you; (ii) automatically fill in documents associated with the transactions you make to purchase products; (iii) process and treat your information to adapt the supply of products and services to your customer profile or to make analyses, reports and evaluations in this respect; and (iv) design commercial actions or after-sales services, both general and targeted, to improve your customer experience.
You may revoke your authorization at any time and you will always have the right to clarification, correction, cancellation and objection and all other rights granted by Privacy Protection Law 19,628. The supplier’s registered offices will be its commercial offices located at Avenida Santa Lucia 330, 2nd floor, Santiago, Chile. The competence of courts will be determined by the address you have given when registering on the Site. Otherwise, it will be the municipality where you reside. This notwithstanding, the rules of competence in Article 50-A of Law 19,496 may always be applied. If the purchase order is from a foreign country, the contract will be deemed made, for these same purposes, in the municipality of Santiago, Chile.
VALIDITY AND EFFECTIVENESS OF THESE TERMS AND CONDITIONS:
These Terms and Conditions enter into effect in July 2021 and govern as from that date. They may only be amended because of certain eventualities of the brand that will not be previously notified to customers but rather posted on the Site in detail in a reasonable period of time. The changes will apply to purchases immediately upon being posted. These Terms and Conditions are binding upon all Site users.
Customers may not unilaterally terminate contracts made on the Site. However, they will enjoy the legal guarantees and benefits additional to the Consumer Law indicated above.

Anicy Manuguian offers unique, one-of-a-kind products because most of its garments are completely hand-made from world-class natural fibers, like baby alpaca wool, Pima cotton, and viscose rayon, that guarantee the exclusive effects of the brand. It is therefore likely that there will only be one product of each kind that will not again be in stock in the future.
RECOMMENDATIONS ON PRODUCT CARE
KEEP the garments folded in the closet, never hung.
PROTECT the garments, ideally inside a cloth or similar bag.
DRY-CLEAN the garments as they are delicate, to avoid rough handling. The garments cannot be washed in water or a washing machine.
REMOVE jewelry and accessories before putting garments on or taking them off.
AVOID CONTACT with sharp surfaces that might snag the garment.
STRETCHING OR WIDENING may occur in hand-knitted garments because of use, as they adopt to the body.
HOW TO PURCHASE ON THE SITE:
Please take the following steps to make a purchase on the Site:
Click on the product you like, and the description, size, availability in stock and price will appear, then add it to your cart. A page will pop up on your screen with the product details, the price, and a window where you can input your address to calculate the cost of shipment via DHL. The total price of your purchase will then appear, shipment charges included. You can then choose to insure the shipment (extended liability service) to protect your purchase from loss or damage. Insurance is optional and payable by customers. No insurance charge will appear if you do not choose to buy insurance. Insurance costs 1% of the purchase price and it is recommended for international and regional purchases. Then click to complete the purchase and a form will appear where you can input the customer information: full name, shipment address, city, region, postal code, phone number and e-mail address. Click to complete the order and different payment alternatives will appear for your national or international purchase. Select your preferred payment method to finalize the purchase.
An order will be created upon finalizing your purchase at our online store that will automatically engage in an identity confirmation process to protect you, and to check the availability, good standing and available credit in the means of payment selected. You will receive the purchase order at the e-mail you indicated, which will describe the product, the purchase total and a unique order number that you can use to track your order.
Once the above process has ended, the means of payment will be charged, the proof of purchase will be sent, together with the e-bill or e-invoice, and the product will be shipped via DHL, which is the courier used by Anicy Manuguian.
MEANS OF PAYMENT USABLE ON THE SITE:
Save indication otherwise for specific cases or offers, the products and services offered on this Site are only payable by:
Credit cards, in the installments offered by each bank.
All means of payment available on Flow, operated through WebPay, such as debit cards and Visa, Mastercard, Diner’s Club International, American Express and Magna bank credit cards issued in Chile, provided the contract for these cards is in force.
PayPal, for payments made abroad, where all means of payment authorized on PayPal can be used. In the event of returns or purchase order cancellations, the refund times will depend on each bank used for payment by the buyer. PayPal will contact each buyer by e-mail.
Bank debit cards active in the Redcompra® system, issued in Chile by domestic banks that have an outstanding contract with Redcompra®.
OnePay and Prepago, offered on the Site.
Debit or credit card through WebPay, operated by Flow Payment Solutions in which the customer is automatically charged.
If a transaction in Chile is voided for any reason, such as a return or purchase order cancellation, Flow will contact you regarding the refund. Refunds for payments made via a debit card may take as many as 48 hours after the customer sends the information to Flow for a refund. Reimbursements for payments made by credit card can take as many as 15 days. Please remember that all aspects relating to the use of credit or debit cards, such as issue date, expiration date, line availability, blocking, etc., will be subject to the stipulations in the respective card contract and usage regulations of the company issuing or operating the card, which will prevail in the event of any contradiction.
Please contact us by e-mail to void an international transaction made through PayPal (return or purchase order cancellation). Any product you wish to return must be returned in perfect condition, and customers will defray all costs of the return freight, including insurance. Refunds will be made through PayPal once the product has been received, inspected and accepted. PayPal will contact you by e-mail.
BRIDAL AND HAUTE-COUTURE LINES AVAILABLE ON THE WEBSITE:
Please contact the designer before buying in the bridal and haute-couture lines so that she can answer your questions about the details of the garments and any doubts about measurements and the fit of each dress. The purchase can be confirmed and payment made after discussing all these details. Feasible alterations will begin to be made to garments after payment, as discussed with the customer. Given the hand-made nature of our garments, agreed alterations are charged and will take extra time to complete. The budget and estimated delivery dates of the finished garment will be notified to the customer by email or phone.
POLICY ON SHIPMENTS AND DELIVERY TIMES
PRODUCT SHIPMENT AND PURCHASE PROCESSING:
Purchases are processed between 24 to 48 hours after receiving the purchase order, and shipment will be made, if within Chile, within 5 to 10 business days after purchases have been confirmed, or if international, within an average of approximately 30 days because of the worldwide Covid-19 crisis. Each shipment will be confirmed by e-mail to the customer. Please input the full, exact shipment address so that your product will arrive without trouble. The person receiving the product upon delivery must sign a receipt acknowledgement that will indicate that the person is receiving the product to full satisfaction. Any dissatisfaction must be notified the same day as delivery to email@example.com or by phone at +56 993188674.
We use DHL to make shipments and each shipment may be insured (extended liability service) at the customer’s choice. We recommend purchasing the insurance for regional and international shipments as it will assure good customer service throughout the process, receipt of the product in good condition, and a refund of the price paid if there is any loss or damage, to be confirmed and accepted by DHL.
Delivery time is approximately 5 to 10 business days after the purchase is confirmed. Insurance coverage (extended liability service) is available through DHL and can be purchased by the customer at the time of purchase. This insurance coverage will assure protection throughout the process, receipt of the product, and a refund of the price paid if there is any loss or damage, to be confirmed and accepted by DHL. The insurance is payable by the customer and if chosen, the particular charge will appear. Shipment is at no charge to the municipalities of Providencia, Lo Barnechea, Vitacura, Las Condes and La Reina in the Metropolitan Region of Chile.
Taxes, customs duties and costs in each country of destination are not included for international shipments. Delivery time is no more than 30 business days and, given the worldwide COVID-19 crisis, delivery dates will be confirmed by e-mail to each customer once the estimated arrival time has been confirmed with DHL. Insurance coverage (extended liability service) is available through DHL at the customer’s expense and can be purchased by the customer at the time of purchase. If insurance is chosen, the rate to destination will appear. We recommend purchasing the insurance for international shipments as it will assure protection and good service throughout the shipment process, receipt of the product in good condition, and a refund of the price paid if there is any loss or damage, to be confirmed and accepted by DHL.
ONLINE PURCHASE TO BE PICKED UP AT THE ATELIER:
Should you choose to pick up your product at our Atelier, please do so at the agreed appointment time. All pick-ups must be made at the Atelier within 10 business days. We will let you know by e-mail or WhatsApp message when the product is ready and the time to pick it up. The transaction will be reversed if the product is not picked up at the specified time and the corresponding refund will be made.
COVERAGE AND REFUNDS FOR DAMAGES OR LOSS DURING SHIPMENT:
DHL offers extended liability coverage for both national and international shipments under which customers may receive a refund of their purchase, plus freight costs, if it is proven that DHL caused the loss or damage to the package. Customers who have purchased the insurance must promptly report receiving a package in poor condition or damaged or not receiving it to firstname.lastname@example.org.
The steps to take to report an insurance claim under DHL’s extended liability coverage are:
Report the claim to the next email address email@example.com or by phone or WhatsApp at +569 9318 8674.
Take pictures of the damage to the package and send those pictures and a copy of the invoice or bill of purchase and any other information to the above e-mail address to make the claim to DHL and process a refund.
DHL will analyze the evidence and if the damage or loss is confirmed, it will proceed with the refund.
Refunds for national purchases:
DHL will refund the amount of insured national purchases, plus freight, directly to the customer’s account.
Refunds for international purchases:
Anicy Manuguian SpA will refund the amount of insured international purchases, plus freight, after DHL has confirmed the insurance claim.
In both cases, refunds may take as many as 45 business days. DHL assumes no liability for loss or damage to products not covered by the extended liability insurance and all such costs will be borne by customers.
The insurance cost is 1% of the product price. That price will appear when insurance is chosen and will be added to the product price and shipment charges.
EXCHANGE AND RETURN POLICY:
Should you need to make an exchange or return, the first step is to contact the designer by phone, at +569 9318 8674, or by e-mail to firstname.lastname@example.org, to indicate the reason for the exchange or return. Please identify the product in the e-mail and attach the invoice or bill together with your full name and phone number. You can exchange products within 20 calendar days after purchase and make returns within 10 calendar days from the date of purchase, whether the purchase was made at the Anicy Manuguian online store or in the Anicy Manuguian Atelier.
Exchanges are currently possible within 20 calendar days after you purchase a product. Please contact us at email@example.com or by calling +569 9318 8674 to explain the reason for the exchange. We will support you throughout the process.
Exchanges will be made provided the product has not been used and is undamaged by, for example, snags, make-up or other types of spots, alterations to the embroidery and crystal appliqués, perfume smells, breaks or undone stitches anywhere in the garment, and it has not been washed. The original labels must be in place and the original packaging returned as well. The exchange is subject to quality control by the designer and it will not be made if the garment is not in good condition.
You must present the invoice or bill and pay any difference between the original price and the price of the replacement product chosen. Exchanges will only be made for products of the same or a higher price.
EXCHANGES AT THE ATELIER:
Exchanges will be made at the Atelier by appointment only. You must return the product that you wish to exchange by presenting the bill of purchase. The product must not have been used, it must be undamaged by, for example, snags, make-up or other types of spots, alterations to the embroidery and crystal appliqués, perfume smells, breaks or undone stitches anywhere in the garment, and it must not have been washed. The original labels must be in place and the original packaging returned as well. The exchange is subject to quality control by the designer and it will not be made if the garment is not in good condition.
Please remember that our products are unique, so our stock is limited. We recommend confirming the availability of the product you wish to select in exchange and the price before making the exchange.
Customers may return products bought at the Anicy Manuguian Atelier or online store within 10 calendar days after the date of purchase. You must present the bill or invoice and the garment must pass the quality control by the designer. The purchase price will then be refunded.
RETURN OF PRODUCTS TO THE ATELIER:
Please schedule an appointment at our Atelier during store hours and deliver the product to be returned together with the bill of purchase. The product must not have been used, it must be undamaged by, for example, snags, make-up or other types of spots, alterations to the embroidery and crystal appliqués, perfume smells, breaks or undone stitches anywhere in the garment, and it must not have been washed. The original labels must be in place and the original packaging returned as well. The return is subject to quality control by the designer and it will not be made if the garment is not in good condition. Once the good condition of the garment is confirmed, we will contact you to refund your money. COVID-19 POLICY: Returns can be made online, given the worldwide contingency, following the steps below:
PRODUCT RETURN BY COURIER:
Should you choose this alternative, please ensure that the product is in perfect condition and that it is properly packaged and sealed. For your ease of mind, we recommend that the garments be insured as they must be returned in perfect condition, must not have been used, must be undamaged by, for example, snags, make-up or other types of spots, alterations to the embroidery and crystal appliqués, perfume smells, breaks or undone stitches anywhere in the garment, and they must not have been washed. The original labels must be in place and the original packaging returned as well.

Mailing and insurance costs are payable by the customer.
You can track your package to destination as allowed by the courier. Please write to firstname.lastname@example.org if you have not received confirmation of receipt at the above destination by the end of two weeks.
*Customers must confirm the condition of their packages with the courier/delivery service, and request that they note the name and identification number of the person receiving the package. Customers must resort to the courier or delivery service they retained if the package is lost en route.
We will contact you to make a refund of your money once we have received the products at the Atelier and have inspected and confirmed that they are in good condition.
PURCHASE ORDER CANCELLATION:
Should you wish to cancel an online order, please give us notice sufficiently in advance before it is scheduled for shipment.
We cannot cancel delivery orders once the product has been delivered to our courier.

Refunds will be processed for both national and international purchases once the product has been received in good condition and has undergone a quality control by the designer. No refund will be made if the product does not pass the inspection. If order cancellation is approved and the purchase was made nationally, we will process your refund on the Flow payment site, which will contact you. PayPal will be used to refund international purchases, which will contact you. Refunds will be made according to the respective payment intermediary’s regulations.
REFUNDS OF NATIONAL PURCHASES:
Money will be refunded depending on the method of payment used. Flow will be used to refund national purchases, and it will contact the customer to process it.
Your money will be refunded in no more than 15 days if you paid via credit card. The refund will be made through Transbank.
Debit card payments will be refunded within 48 hours after the customer sends their bank information to the Flow system. Refunds will be made directly to bank accounts and the transaction will be notified by e-mail.
REFUNDS OF INTERNATIONAL PURCHASES:
Please contact us at the next email address firstname.lastname@example.org regarding the refund of an international purchase. Please explain the reason for the return of a product. The product must not have been used, it must be undamaged by, for example, snags, make-up or other types of spots, alterations to the embroidery and crystal appliqués, perfume smells, breaks or undone stitches anywhere in the garment, and it must not have been washed. The original labels must be in place and the original packaging returned as well. The return is subject to quality control by the designer and it will not be made if the garment is not in good condition.

Once the product has been received, inspected and the return accepted, we will contact PayPal to process the price refund. PayPal will contact the customer by e-mail.
Refund times will depend on the bank used by the customer to make payment.
